Who we are

b-nimble.com and bnimblemedia.com are run by B-Nimble Media LLC, a Pennsylvania limited liability company based in Reading, PA 19605 (“B-Nimble Media”, “we”, “us”). By using the site you agree to these terms. If you do not agree, please do not use it.

Using this site

You may browse, read and share links to the site. Please do not attack, overload or probe it for weaknesses, try to reach the admin area or other people’s data, scrape it in bulk, or use the forms to send spam. We may block addresses that do.

Client work is agreed in writing

Everything on this site, including service descriptions, budget ranges, timelines, the free guide and examples, is general information, not an offer. Any project or retainer is governed by a written proposal or contract that we both sign. If that contract and these terms disagree, the contract wins.

• Prices: you get a written scope and price before work starts. We charge only what your signed proposal lists. Third-party costs we buy on your behalf (such as domains, app-store fees, software licences or advertising spend) are passed on only as your proposal sets out, and changes are priced and agreed before they happen.
• Retainers run month to month and you can cancel with 30 days’ notice.
• Refunds follow our refund policy and your contract.
• Results: we commit to the work in the proposal, not to particular rankings, traffic, sales or advertising results, which depend on factors outside our control.

Who owns what

• Your work: the code, accounts, domains and data we create for you are yours, as our services page says. Your contract sets out the details, including any third-party components that stay under their own licences.
• This site: its text, design, B-Nimble logo and code belong to B-Nimble Media LLC.
• Our portfolio: the case studies show websites, apps and logos we designed and built. Each client’s name, logo and brand belong to that client and appear only to show work we delivered; showing them does not mean the client endorses anything else.
• Fonts and software on this site are used under their licences; see licenses and credits.

The free guide

The guide is free and comes with no obligation. It is general information about choosing a software or web agency, not legal, financial or technical advice for your situation.

Links to other sites

We link to client websites and other sites for reference. We do not control them and are not responsible for their content or privacy practices.

No warranty

The site is provided “as is”. We work to keep it accurate and available but do not promise it will be error-free or uninterrupted. Warranties for client work are those in your contract.

Limitation of liability

To the extent the law allows, B-Nimble Media LLC is not liable for indirect or consequential loss arising from your use of this website, and our total liability for anything arising from the website itself is limited to US$100. Liability for client work is governed by your contract. Nothing here limits liability that cannot be limited by law.

Privacy

Our privacy policy and cookie policy explain how we handle personal data.

Governing law

These terms are governed by the laws of the Commonwealth of Pennsylvania, USA. Disputes about them go to the state or federal courts serving Berks County, Pennsylvania, unless your contract or the law where you live says otherwise.

Changes

We may update these terms; the date at the top shows the latest version. Changes do not alter a contract already signed.
